Terms and Conditions of Sale

These Terms of Service ("Terms") govern your access to and use of clayaw.com (the "Site") and every purchase you make from Clayaw ("we", "us"). Please read them carefully. By using the Site or placing an order you agree to these Terms, to our Return and Refund Policy, our Shipping Policy and our Privacy Policy, which are incorporated by reference. If you do not agree, please do not use the Site.

Age Requirement

You must be at least 18 years old, or the age of majority in your state, to make a purchase. The Site is not directed to children under 13 and we do not knowingly collect personal information from them; if we learn that we have, we delete it. By ordering you represent that you are legally capable of entering into a binding contract and that the payment method you use is yours or you are authorized to use it.

Prices and Taxes

Prices are quoted in USD and can change without notice, but the price you see when you order is the price you pay. Applicable taxes (calculated at checkout based on the shipping address) and any shipping charge appear at checkout before payment, so the final total is always visible before you commit. Promotional "was" prices are genuine prior prices. Should an obvious pricing mistake occur, we are not obliged to sell at the wrong price: we will tell you and let you decide whether to proceed.

Refund and Cancellation Policy

You may cancel an order free of charge before the order ships and return most items within 90 days of delivery for a refund or exchange. Items must be unused and in their original packaging; certain products are non-returnable for hygiene or legal reasons. Returns are free — we cover return shipping. Returns are sent to 61 Cottonwood Way, Lake Placid, NY 12946, United States. Approved refunds are issued 5–10 business days after we receive and inspect the item to the original payment method, and refunds for cancelled orders within 7 business days. Damaged, defective or incorrect items are replaced or refunded at our cost. The complete Return and Refund Policy is part of these Terms and is presented to you before checkout.

Shipping

Delivery is available to the United States. Processing takes 1–2 business days, then 9–16 business days with Standard Shipping (USD 7.99; free from USD 169) or 7–11 business days with Fast Shipping (USD 20.90). Tracking is provided for every shipment. Should a shipment be delayed beyond the promised date, we tell you in advance and you may cancel free of charge for a full refund, as required by the FTC Mail, Internet, or Telephone Order Merchandise Rule. Orders and Contract Formation

Your order is an offer to buy. After checkout you receive an order confirmation email; this acknowledges receipt of your order but does not accept it. A contract of sale is formed when we ship the goods and send the shipping confirmation. We may decline or cancel an order before shipment for reasons including unavailability, a pricing or description error, suspected fraud, or a shipping address we cannot serve; if we do, any payment is refunded in full within 7 business days. We may limit quantities per order or per customer.

Payment

Accepted payment methods: Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay and Shop Pay. All transactions are handled by Shopify Payments (powered by Stripe) using industry-standard encryption; card details never touch our systems. Charges are made at the time of order and show on your card statement as CLAYAW.COM. Orders may be held for verification when the billing and shipping details do not match or our provider detects unusual activity; we will contact you if we need anything. For any billing question, write to contact@clayaw.com and we will look into it right away.

Product Information

We make every effort to describe products accurately and to show them as they are. Colors may vary slightly with your screen settings, and dimensions are approximate unless stated as exact. Our products are unbranded, generic items sourced from selected manufacturers; any brand names appearing in descriptions are for compatibility reference only and do not indicate affiliation. Product availability is not guaranteed until an order ships; if an item becomes unavailable we contact you with the options of waiting, a substitute or a full refund. We do not use false scarcity or countdown claims.

Liability

Our responsibility to you for any order is capped at the price you paid for it, and we are not responsible for indirect or consequential losses — such as lost profits or lost data — to the extent the law lets us exclude them. Nothing in these Terms limits liability for personal injury or death caused by our negligence, for fraud or fraudulent misrepresentation, or any liability that consumer protection law does not allow us to limit. Where your state or country does not permit some of these exclusions, they apply to you only as far as the law allows.

Warranties and Disclaimer

Products are covered by the 12-month limited warranty against manufacturing defects described in our Return and Refund Policy. To the extent permitted by law, any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the term of that limited warranty. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. The Site itself is provided "as is" and we do not warrant that it will be uninterrupted or error-free.

Content Ownership

All content on the Site — text, product descriptions, photographs, graphics, logos and the Clayaw name — is owned by or licensed to us and is protected by copyright and trademark law. You may view and print pages for personal, non-commercial use only. Reproducing, distributing or using our content for any other purpose without written permission is prohibited. If you believe content on the Site infringes your rights, email contact@clayaw.com with the details and we will respond promptly.

Acceptable Use and Reviews

Use the Site lawfully and in good faith: no fraudulent or unauthorized orders, no attempts to breach security, no automated scraping, no abuse of discounts. Reviews on our product pages come from customers who bought the product; we take reasonable steps to verify them and never commission fake reviews. Content you submit must be truthful and yours; you allow us to publish it and we may remove anything inappropriate.

Disputes

The law of New York, including the New York General Business Law § 349-350; refund policy disclosure under GBL § 218-a, and U.S. federal law govern these Terms. We ask that you raise any problem with us first — write to contact@clayaw.com and give us 30 days to put it right. If that fails, you and Clayaw agree to resolve the dispute through binding arbitration on an individual basis before the American Arbitration Association (AAA) under its consumer arbitration rules (the Federal Arbitration Act applies), or in small claims court if the claim qualifies. Both parties waive the right to a jury trial and to participate in class or representative actions. You can reject this arbitration clause by notifying us in writing within 30 days after your first order; the rest of the Terms will still apply. You always retain the right to complain to your state attorney general or the FTC.

Other Terms

We may update these Terms from time to time; the version in force when you place an order applies to that order, and the current version is always available on the Site with its "last updated" date. If any provision is found unenforceable, the remainder continues in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Site and your purchases. You may not assign your rights under these Terms; we may assign ours to a successor of the business.
