Privacy Policy and Notice

This Privacy Policy describes how Clayaw ("we", "us"), operated by Clay Allen Howard, collects, uses, shares and protects personal information when you visit clayaw.com or buy from us, and the choices and rights you have. Effective date: September 17, 2026.

1. Information We Collect

We collect the following categories of personal information:

Identifiers and contact details — name, email address, shipping and billing address, phone number, provided when you order or contact us.
Order and payment information — products purchased, order value, and payment details. Card numbers are collected and processed directly by Shopify Payments (powered by Stripe); we see only the last four digits and the payment method.
Account and communication data — messages you send us, reviews you submit, and your customer service history.
Device and usage data — IP address, browser type, device identifiers, pages viewed, referring URLs and interactions with the Site, collected automatically through cookies and similar technologies (see our Cookie Policy).
Marketing preferences — whether you have subscribed to or unsubscribed from our emails.

Our store runs on Shopify, which hosts the Site and processes orders on our behalf. This policy applies to information collected through clayaw.com, by email, phone and our contact and return forms.

3. How We Use Your Information

We use personal information to: process and deliver your orders and send order, shipping and delivery updates; provide customer support and handle returns, refunds and warranty claims; prevent fraud and protect the security of the Site and our payment provider; comply with legal obligations, including tax and consumer protection laws; improve the Site, our products and your shopping experience through analytics; and, with your consent or where permitted, send you marketing communications about our products and offers. We do not use your information for automated decisions that have legal or similarly significant effects on you.

4. How Long We Keep Your Information

We keep order and transaction records for 7 years after the purchase to meet tax, accounting and warranty obligations; customer service correspondence for 3 years after the last contact; marketing preferences for as long as you remain subscribed and for a reasonable period after you unsubscribe so we can honor your choice; and analytics data in aggregated form. Information is deleted or anonymized when no longer needed for these purposes, unless a longer period is required by law or to resolve a dispute.

5. Third Parties

We do not sell your personal information, and we share it only as needed to run our business: with Shopify (platform hosting, checkout and order management); payment processors (Shopify Payments (powered by Stripe) and the payment methods you choose) to authorize payments and prevent fraud; shipping carriers and fulfillment partners such as USPS, UPS and JS Express located in the United States, China and the European Union, who receive your name, address and phone number to deliver your order; tracking, email and customer service tools that help us communicate with you; analytics and advertising partners (such as Google and Meta) that process usage data through cookies as described in our Cookie Policy; and authorities or advisers when required by law, to enforce our terms, or to protect rights and safety. If the business is sold or merged, customer data may be transferred to the successor under the same commitments.

6. Your Choices and Rights

Regardless of the state you live in, you can ask us to: access the personal information we hold about you; correct inaccurate information; delete your information (subject to legal retention); receive a portable copy of it; and opt out of marketing, of targeted advertising cookies (on the Cookie preferences page), and of any sale or sharing of your data (we do not sell it). We will not discriminate against you for exercising these rights. Send requests to contact@clayaw.com with the subject "Privacy request"; we verify your identity using the email associated with your orders and respond within 45 days. If we decline a request, we explain why and you may appeal by replying to our response. Do Not Track: our Site does not currently respond to browser Do Not Track signals, but we honor Global Privacy Control opt-out signals for targeted advertising where technically supported.

7. How We Protect Your Information

We protect personal information with technical and organizational measures appropriate to the risk: the Site is served over HTTPS/TLS, payments are processed by PCI-DSS certified providers, access to customer data is limited to people who need it, and our platform providers maintain independent security certifications. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security; if a breach affecting your data occurs we will notify you and the relevant authorities as required by law.

8. Minors

We do not sell to or knowingly collect data from children under 13 (COPPA). Should we learn that we hold information from a child under 13 without verified parental consent, we delete it. Parents or guardians who have concerns can reach us at contact@clayaw.com.

9. Marketing Emails

We send marketing emails only to customers and subscribers, and you can stop them at any time using the unsubscribe link at the bottom of each message or by emailing contact@clayaw.com; we process the request within 10 business days. Our emails always show who they are from and our physical mailing address, in compliance with the CAN-SPAM Act. Opting out of marketing does not affect order confirmations, shipping notices or replies to your requests.
